APRIL 6 REFUND THREAD: Have you received your refund?

You bet I'm still ticked off, as every single CCL customer who has been made to wait to get their money back IN VIOLATION of a LEGAL CONTRACT.

Had Carnival refunded my money in the time frame THEY quoted on the written cancellation confirmation THEY provided, I would not have been deprived of the deferred interest terms on the $1532.90.  For me, that means a loss of several hundred dollars that is UNRECOVERABLE.

For a small businessman who is 1) trying to stay alive financially, and 2) trying to put food on the table, several hundred dollars is significant.

Would YOU voluntarily set 3 crisp $100 bills on fire and let them burn without doing ANYTHING to stop it?

And don't even THINK about blaming ME (or any other customer) for ANY delay for ANYONE.  Carnival had my money to use for FREE for almost a year.

The only truly equitable method for refunding monies would have been FIFO....  First IN, First OUT....  IAW:  Refunds SHOULD have been scheduled based on the date CARNIVAL took possession of the funds.

I recieved my Fun Shop charges this morning for both my April 5 and 11 cruise. They previously refunded me about $166, but I’m not sure what that charge was for. I had a B2B booked with prepaid gratuities, insurance, excursions, and purchases. My FCC was immediately transferred to my January cruise, and $914 of my refunds went directly from Carnival to pay off that balance. I figure I still have about $400 more coming. I will keep checking. Oh, and BTW, although those two Fun Shop refunds of $65 each (total$130) showed up just this morning, I had to back in my account to see a refund, as my balance was less this morning than last night. The refunds were dated April 9. That must be when Carnival processed them.

Please point out in the contract where it says anything about timely refunds or refunds at all. If it's not in the contract, specifically spelled out, then it's not a contract violation. Not paying interest charges isn't really a savings except maybe in the eyes of a marketer, you can avoid interest charges by not making the charge to begin with (or by paying the charges in full before the end of the billing cycle). It would be different if you were talking about some sort of credit for using a particular card, such as cash back or points, but as noted above for Amex they take that credit back if you receive a refund for the charges. I'm not blaming you for anything, but as I pointed out others might not be so charitable. I've already addressed your idea of first in/first out.

Cruise canceled April 2 and excursions refunds posted on May 12.  The bad thing is I elected to leave me deposit for FCC and saw they refunded that yesterday.  Called, but didn't want to wait the hour to hear somebody tell me that it was their error, but there was no way to fix it now that it had been refunded.

WRITTEN letter from Carnival to me dated 03/22/2020, lists NO PENALTY applied and states:


"A refund of the government fees and taxes will be processed to the original form of payment within 10-14
business days.
"

I STILL have not received that refund.  That written document constitutes a "written and approved" modification of the original CCL Ticket Contract under US Law.

CCL's Contract says I am entitled to a refund.  I complied with the terms of the contract to cancel the booking and requested a full refund back to original payment sources.  Carnival ACKNOWLEDGED and AGREED to MAKE the refund, again the Cancellation Letter...

The Question at hand is what law governs how long CCL can LEGALLY hold my money rather than return it AS AGREED.

As for all their attempts to limit the Buyer's Rights under their boiler-plate contract, et al. I suspect a Federal Judge would set those aside, based on the fact that it IS a boiler-plate contract where only ONE-SIDE had a reasonable opportunity to "negotiate".

CCL cannot simply "exempt" themselves from the law.  I'll guarantee you that there is a law somewhere that defines the maximum term a merchant can hold funds AFTER it has agreed to make a full refund.


Not paying interest charges isn't really a savings except maybe in the eyes of a marketer, you can avoid interest charges by not making the charge to begin with (or by paying the charges in full before the end of the billing cycle).

You don't have much experience in capital management, do you?  I have terms where EVERY purchase I make over $99 is 6 months deferred interest INDIVIDUALLY tracked by purchase.  As long as I pay THAT purchase off in under 180 days from date of purchase, I pay NO INTEREST at all.  It is effectively a 6 month no-interest loan.  At CC interest rates (mine are average 10% or less), that is a significant savings.  It is NOT marketing.... it is MATHEMATICS and finance.

I don't really care what YOUR opinion of FIFO is, I pretty much only care what a court will say when the lawsuits start hitting.

Based on what I am hearing, Carnival may well not survive this.  I wouldn't book a cruise with them now if my life depended on it.

I have a question in the OBC carnival is offering along with the FCC option.  Am I able to choose which cruise I use the OBC or is it only added to my next cruise? My next cruise (Nov 2020) has Casino OBC, but my cruise after that (Feb 2021) does not have any OBC (except for the  shareholder benefit).

 I received my replacement gift cards   this week. I was stunned. As  I have no other place to spend the cards, I am booked on another cruise for next year.
I will NEVER pay for a cruise with gift cards again. I will NEVER  buy travel gift cards  again.
But After getting the cards back, I was not so mad at Carnival.
I like cruising. I have never had another complaint against Carnival. I am not quite the cheerleader I used to be, but it is going to be tough on Carnival. Everyone I know is scared to death of this disease and the doctors, imho, pile it on. 
I still have about $400 in a cruise credit I think, and I did not get the $600  in onboard credit because my daughter's name was on the booking, but on my credit card. That chaps me.
But all in all, I am a lot happier with Carnival than before this lock down.
AND I do not believe there was any covid-19 on Carnival ships. I know they were on Princess, and HAL, and they are owned by Carnival, but ran by other groups. I have always felt like Carnival was clean.

A refund of $800 posted to my credit card this morning from a booking originally made/paid in November 2018 and cancelled in March and then again in April.   I paid the remainder of my cruise in Carnival gift cards so this is the only cash/credit refund I am expecting.  My refund status is a mess to be honest, because I originally had a May 30th cruise for 5 to Europe that was cancelled with no penalty.  Our airfare was purchased and paid through Carnival and I used gift cards to pay for that as well.  Basically the only cash I used was the deposit.  When the May 30 cruise cancelled I immediately just transferred everything including airfare to a September  of 2020 cruise.   A couple of weeks later that was cancelled also.  I called and took the FCC option- but had my PVP immediately book us onto a European cruise in September 2021.  He transferred everything he could, but that cruise was less expensive than the two previous bookings.  And airfare is not yet available for September 2021.   So I will be getting additional refund but it should be on Carnival giftcards and I presume will take a while longer.

Before the lock down I had cancelled a cruise. and they fedexed the portion of the cruise I paid on gift cards with in 2 days of my cancellation. Now that was pre Covid, YMMV now.

I'm sure that their lawyers will make short work of the email, which doesn't modify the contract at all. The court will take all of the relevant facts into consideration, whether you want them to or not. Even boilerplate contracts stand up to judicial scrutiny quite well and are not as easy to get tossed out. Again, I wish you luck in your quest.

6) On April 9th, 2020, I filed a dispute with Citi, claiming failure to refund monies for services not received.  I included ALL relevant documentation including the cancellation letter, the online cancellation policy, AND the boiler plate "Cruise Contract" with applicable passages highlighted.... in the total amount of $1532.90

 

7) On April 9th, 2020, I filed a similar dispute with Synchrony Financial in the amount of $718.00

8.  On April 10th, Synchrony confirmed receipt of dispute and documents.

9) On April 11th, Citi confirmed receipt of dispute, and requested documentation (that had ALREADY been submitted).

10) On April 15th, I filed a complaint with the Louisiana Attorney General's office against CCL for failure to refund for services not rendered and failure to maintain required escrow funding.

11) On April 15th, I lodged complaints with my Louisiana State Rep and Senator.

12) On April 15th, I lodged complaints with my US Representative, and both Senators.

There is NO balance on these cards to suspend.  I pay my bills in full EVERY month, regardless of the circumstances.
Carnival Cruise Lines should do the same.  IF I owed THEM $2,250.90, they sure as heck wouldn't let ME have 90+ days or forever...

Carnival has an accounting issue.  WE have a "putting food on the table" issue, as we, like many of you, have lost ALL sources of income.

What Carnival, et al. are doing is reprehensible and tantamount to criminal theft.

I am billing Carnival for the use of my funds at 22.5% interest calculated on an average daily balance method.

They will pay the full refund AND interest in excess of the MAX 14 business days THEY quoted to me IN WRITING, or I will place a lien on the Carnival Glory and sue them for the funds AND the pain and suffering they are causing my family.

I will never sail on Carnival Cruise Lines again....  EVER!
 

What is the result? Did you receive a refund or still waiting?

I received fun shop refunds yesterday. Cancelled on 4/14 but still waiting on excursion refunds . All cancelled on the same day so not sure why only some have posted . Unless different departments handle excursions vs fun shop purchases

Pardon me if this has been asked already, but for anyone who has a refund issued, by chance did you get an email from Carnival saying that the refund had been processed/issued and where the refund went?

 

The reason I’m asking is that out of the 4 active bookings I had going on, I was spreading payments around to maximize points/rewards and never would have thought that I had to worry about such a thing as what payment went on what card.

 

I’m only refunding 1 cruise, the only other that was impacted I FCC’ed over one for March ‘21 and my PVP did all the legwork on that to make sure monies moved where they should.

I received my refund on Thursday and only knew it was there because I was looking for it.  Carnival did not send me anything advising the refund had been processed.

I canceled everything on the same day but only received cruise fare and taxes. Still waiting on excursions, internet and specialty dining.

I was scheduled in the 5/25 Sunrise out of NYC. I received the cancellation notice 4/13. That day I went online and cancelled my steakhouse reservation & Half Moon Cay Cabana. I also used the online form to request a full refund. 
 

So far, I have received my dining & excursion refund. They had a transaction date of 4/14 with a posting date of 5/14 & 5/15. 
 

Those are the most straight forward of my refunds. I anticipate my cruise fare & taxes taking a bit longer as the cruise was paid for with funds from the cancelled Legend 5/25 sailing plus an additional credit card charge for the difference. I’m sure that makes the tracing & ensuring proper credit harder on Carnivals side.

 

My PVP did call me 1-2 weeks after the cancellation and could see that I had selected a full refund.

1. Our port fees and taxes came back 1st.

2.  Spa money next

3.  Internet and water last.

Everything else we had rolled into new cruise.   So we are thrilled with Carnival...every dime accounted for.  

 

Just by these boards, Carnival is doing a GREAT job compared to Princess.  I can't find a post yet where someone has been refunded.

That’s awesome! When was your sail date? When was the refund date?

Just got notice of my fun shop purchase on my credit card  for my 4/25/20 Panorama cruise,  kind of forgot all about it!
