rich40245 Posted July 8, 2009 #255 Share Posted July 8, 2009 I always find it funny how ignorant people are about the law and their rights. People ove to quote free speach and peaceful assembly, but that only applies to govern and public lands. A private company can take away your right to free speach and doesn't have to allow you to peacefully assemble on their private proverty. Passengers must remember when cruising that most cruise ships are not USA registered ships or crew. When on a cruise you are not in USA waters and you are not protected by the US constitution or laws and are at the mercy of the rules of the cruise line until you return home. What the morons in the video don't realize is that once the ship is in international waters, your rights that you enjoy as Americans in the USA no longer exist. You are not in the US and not protected by the constitution and the bill of rights. You do not have the right to free speech on a ship, nor do you have the right to assemble, etc. U.S. Constitution: Amendment I Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the government for a redress of grievances. The way I read this, it prohibits the U.S. Congress from doing things like restricting free speech, or assembly. Carnival Cruise Lines, on the other hand, is free to do what ever they want, even when in U.S. waters. Rich
salty dingo Posted July 8, 2009 #256 Share Posted July 8, 2009 U.S. Constitution: Amendment I Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the government for a redress of grievances. Carnival Cruise Lines, on the other hand, is free to do what ever they want, even when in U.S. waters. Rich That's right, Rich! You've nailed it. Carnival is not subject to any part of the US Constitution. And we're all glad of that.
salty dingo Posted July 8, 2009 #257 Share Posted July 8, 2009 Here's a rebuttal to those who use the "freedom of speech" and "freedom of assembly" arguments: If this dispute happened in a US hotel, security would have quickly escorted the guests out to the curb, along with their belongings. On a ship in the ocean, that's not easy to do. You can do it, but the passengers would probably drown and then you have to defend your actions in court... So, in a "captive" environment like a ship at sea, or an airplane in the sky, passengers have absolutely no right of free speech or of assembly. The MUST OBEY the orders of the Captain, and if they do not, they are committing a criminal offense. In my opinion, Carnival was being generous by not handcuffing these hooligans and having the authorities put them in jail.

OReilyBros Posted July 8, 2009 #262 Share Posted July 8, 2009 The longer this has gone on, and the more attention we are giving it, makes me wonder if we are just playing into the hands of those that seek and desire the spotlight more than anything else in life, including having fun on vacation.... G'ma Posted July 8, 2009 #264 Share Posted July 8, 2009 What's it going to be lady? You have to take the bad with the good. If you and your close knit band of merry idiots take the time to demand free speech when you're not even in the jursidiction of the US Constitution, then wouldn't you support the rights of others to post comments in a public US forum; i.e. You Tube? The video was surely classic! Nine minutes of the rebels without a clue challenging common sense at each turn. I was truly waiting for one of them to ask, "Was it over when the Germans bombed Pearl Harbor?". (Animal House still has relevance!) :D "rebels without a clue" Crikey's, that's FUNNY!!!!!!!!!:D

Nemspy Posted July 8, 2009 #272 Share Posted July 8, 2009 Actually Little Ms Huffy should probably check out whatever defamation law is applicable on board a Carnival vessel. She's made some pretty serious comments about Carnival and the captain of the vessel. The "Freedom of Speech" stuff that she's on about often runs counter to laws about libel, slander etc - You can't defend one person's "rights" at the cost of another person's. newcatintown Posted July 8, 2009 #274 Share Posted July 8, 2009 Here's what I don't get. An executive decision was made. Doesn't mean I have to like it, but in all honesty, do I think me and many other stupid people are going to change their minds by blustering and huffing and puffing? Are we going to blow the house down? What a waste of vacation time. There is that rule of what we can change and what we can't. I can never remember the wording, but do live by the concept. The one that starts with 'God, give me the wisdom to know....'.
