No, she isn't.

 

As long as SHE isn't directly lying to HER insurance company - it is not insurance fraud.

She may be telling YOU to commit insurance fraud, but her telling you to commit insurance fraud is not her committing insurance fraud.

 

If I crash into your car, then tell you to lie about it to your insurance company - I am not committing insurance fraud. If you do what I told you to do - you are committing insurance fraud, but the fact that I told you to do it means NOTHING.
