No it does not have to brand new. But an unsealed bottle of mouthwash will likely be checked for an attempt to smuggle alcohol.

Just to be safe...we have always brought a sealed, new bottle...to avoid problems..

I always bring mouthwash that I've transferred into the small travel bottles you can buy. Never had a problem.
