Last time they got such grief that they are not anxious to reinstitute the fuel charge for sure. They like happy cruisers- not losing in court for whatever the reasons were. They may or may not. Perhaps after the last nonsense with skyrocketing costs, and the outcry from cruisers (who love to complain and grouse---blaming it all on the cruise line, of course), they may have taken care of it already. And if you think that changing cruiselines is going to be the best way for you to retaliate, I guess that's OK too, but if doing so, know that when the first cruiseline reinstates it, the others will follow shortly after and probably will include the cruiseline you elect to change to !
