What are a cruiselines LEGAL responsabilities for missing a port?

As many of you know, the Celebrity Galaxy ship stopped in Charleston SC on 4/7/04, but due to a 'computer malfunction' with the paperwork, the Coast Guard stopped passengers from getting on or off the ship, and it was escorted back out to sea. I was on this sailing and unable to get off. Does anyone know what legal obligations (if any) a cruiseline has to its passengers if it doesn't go to a scheduled port, or in this case, didn't let people off? I'm guessing there's probably fine print somewhere releasing them of any legal responsability, but was thinking in all fairness passangers should be offered a partial refund of their fare plus port charges. Am I wrong here? Has anyone has experience with this?

 

Of course, neither Celebrity nor the Coast Guard has yet taken the blame on this one.

Cruise ships have the right to change and/or miss ports as they deem necessary -- i.e., weather, local conditions, etc., Pax are due no compensation for a missed port, nor if you have an extra day at sea do they charge you for more oil either The usual treatment, however, is for a modest ship credit, open bar, etc.

 

One of the few examples I can think of where they would have some "liability" would be where the ship's mechanical problems made you late for your final port, and you missed your flight (gotten through cruise line). I'm sure they would see that you'd get home........

If you read your contract it states that they may miss, and or change port of call at any time either before or during the trip. Case in point Cartahan and Hati (sp). Due to civil unrest both port are now cancelled. Hurrican season will bring changes too, most of these are not known until just hours before sometimes. Check you cruise insurance for missed planes and extra days.

 

Sometimes, people will get a little extra back as a credit or a free bar hour but the cruiselines do not have to do anything.

Per your passage contract, the cruiselines reserve the right to delete, change or add ports of call at their discretion for any reason or no reason at all. They are not obligated to reimburse you anything, although I believe Carnival has recently added language to the contract that entitles passengers to a $25 shipboard credit as compensation for a missed port.

I believe the original poster was refering to a ship that was not allowed back to it's "home" port. Not a port of call, but the places where the cruise starts and stops.

The Galaxy was not let into port because the proper paper work was not turn in to the Coast Guard. The people in Charleston take port security very serious.

 

I would think the cruise line would owe any port charges for a missed port.
