Long Beach "White" Dome?

Wondering who is responsible for the up keep on the white dome at the Port of Long Beach. We frequently cruise out of this port and I have never ever seen the dome so brown and green with what looks like dirt and mold. This is what it looked like in January 2015. Anyone know if it has been cleaned up yet? :eek:DSC00062.jpg

The answer may surprise you...

 

Here goes an answer maybe only a bored, quasi-retired transactional real estate lawyer would give you.

 

As far as I can tell (see links below), the dome is actually currently owned by the corporation that operates the Queen Mary, Garrison Investment Group--out of New York City by way of the foreclosure on a note to SAVE THE QUEEN, LLC, a Delaware limited liability company-successor in interest to Queen's Seaport Development Inc. It appears that it is only LEASED in part to the Carnival Corporation in a 25 year sublease--which should run out in about 2025.

Now, there is no way to tell for certain without acquiring copies of the January 5, 2000 Sublease between Queen's Seaport Development Inc. as Sublandlord and Carnival Corp as Subtenant. Unfortunately, I cannot locate a copy of that Sublease....or just don't have the stamina to do all the research necessary...Of course I doubt the full document has ever been made public. Corporations don't like to disclose the precise terms of their financial deals.

 

In any event, maintenance of the Dome, MAY OR MAY NOT have been among the terms of that sublease...

Typically, in commercial leasing, if a building is a single-user building, then the responsibility for maintenance of the exterior of the facility is most often placed in the hands of the Teanant. However, if it is a multi-user facility, the Landlord will typically manage the exterior maintenance, usually charging the tenant with a percentage of the cost based on percentage of square footage.

 

Since this Sublease appears to be only for a portion of the premises, my educated guess is that the exterior maintenance therefor falls into the area of responsibility of the Landlord...In this case, Garrison Investment Group--or whichever sub-entity it uses to control the property.

Thanks for all the research Steve, perhaps they are shying away from washing it due to the drought. I'm assuming they do wash it occasionally.
