Scott Boney - Pax who was injured on Elation

Has anyone heard about the condition of Scott Boney who fell down a flight on stairs on the Elation back in September? I was reading a thread on the RCL board and remembered the incident and article that was posted here on CC.

I called the San Diego tribune and asked the person who wrote the article. All he knew was that Scott is out of the hospital and in therapy. If you hear or see anything else, I'd like to know. He said he was going to write a follow up article but I have not seen anything new since September.

This is from the San Diego Union-Tribune - assualt's on cruise ships are fortuately rare - this was news in San Diego. I don't know his current condition, but wish him well.

Injured grocer's family files lawsuit

 

 

Boney critically hurt in cruise-ship incident

The family of prominent San Diego grocer Scott Boney has filed a lawsuit against a man who allegedly was involved in an altercation last week aboard a cruise ship that left Boney hospitalized with critical head injuries. The suit names Caden McCray as a defendant in the Sept. 17 incident that sent Boney tumbling down a flight of stairs on Carnival cruise line's Elation, several hours after the ship sailed from San Diego on a five-day cruise to Cabo San Lucas, Mexico.

Boney, 50, of La Mesa, remained in critical condition yesterday in the intensive-care unit at Scripps Memorial Hospital-La Jolla, a hospital spokeswoman said.

Boney, a second-generation grocer and owner of the Windmill Farms store in San Diego's Del Cerro neighborhood, was put into a medically induced coma after arriving at the hospital a week ago. He underwent surgery over the weekend.

Windmill Farms spokeswoman Aimee Cebulski said yesterday that Boney's wife, Elizabeth Boney, and other family members were declining requests to release more information about the grocer's condition.

FBI Special Agent Darrell Foxworth said the bureau's San Diego office is investigating the incident.

The lawsuit, filed Friday in Superior Court in San Diego, alleges that McCray assaulted Boney but contains no other details of the altercation. The lawsuit does not include any background information on McCray.

The suit seeks at least $50 million in general damages and $50 million in special damages.

Efforts by The San Diego Union-Tribune to locate McCray were unsuccessful.

Daniel Navigato, the San Diego attorney who filed the lawsuit on behalf of Scott and Elizabeth Boney, said the litigation was based on information provided by people who were aboard the ship.

“We understand that the named defendant is the person with whom Scott Boney had the altercation and is the person responsible for pushing Mr. Boney down the stairs,” Navigato said.

Janna Penrose of Utah said she and her family were among those who came upon the scene of the incident shortly after it occurred. Penrose said Scott Boney was lying unconscious on a stairwell landing near the back of the ship. It appeared he had fallen down about seven steps leading from the vessel's promenade deck, which holds a casino, a nightclub and several bars.

Later, Penrose said, a crew member told her that the man involved in the altercation with Boney had been confined to his room for the rest of the cruise. Other passengers said they saw a security guard standing watch in front of a guest stateroom, she said.

“There was a lot of talk on the ship,” Penrose said yesterday in a phone interview. “Some people said there was a fight. Some people said he was drunk and fell.”

Nearly 300 family members, friends and supporters gathered Tuesday on a baseball diamond at Kulken Field in La Mesa for a sunset vigil and rally in support of Boney. Family friends expressed hope for his speedy recovery and offered support to his wife and two children, who attended the event but did not speak to the crowd.

“He's going to do it,” said Ken Soble, a San Diego attorney and family friend. “We're going to have Scotty back in our community before we know it.”
