I'm still waiting for the news to show the first person to file a lawsuit

I hope everyone is ok but it's a coming !!!

 

A few people made some noise about contacting attorneys but the fine print on the paperwork everyone receives when they purchase passage on a cruise pretty much indemnifies the cruise line. I am curious to see if the waivers and such hold up against those who choose to attempt legal action.

People win lawsuits against cruise lines all the time. However, they are not the frivolous lawsuits. I imagine much will hinge on whether the Coast Guard or NTSB finds any fault in CCL for sailing a ship that should not have sailed. That, could cause CCL major problems.

I hope they get nothing if they sue. Carnival is going to compensate the passengers in the right way. They can turn this into something positive if they do the right thing. Like someone last night said make those 3000 ambasadors for life by giving them free cruises for the rest of their lives.

I would not hesitate to go on a Carnival ship. Things happen, go with the flow....

Everybody wants to sue to get money. People are so greedy. Carnival will come through....

Lawsuits sure to come. I agree those that are simply going to use this to make profit are vultures.

 

But I'm sure if any of the passengers have suffered any real loss or damage and it can be proven Carnival were negligent then they probably deserve more than $500 bucks.

If you speak with an attorney that specializes in maritime law, you will find that filing a law suit isn't the easiest of paths. While their vacation was ruined at the end and they endured horrible conditions, unless there is true long term damage then it's not easy and will be costly.

 

Having to eat cold food and being grossly uncomfortable for a few days does not warrant long term damage. As the fire was contained and put out quickly, their lives were not in jeopardy.

 

I am in no way down playing the experience anyone went through, it's just a reality.

I hope anyone who tries to sue loses tons of money in attorney fees for trying to be greedy and profit from something like this. Money is not going to make anything better.

 

Wow. That's nice. Lets wish bad on people. I don't know what each persons experience was and neither do you. Maybe some people have a reason to sue. I don't know and neither do you. Nothing like being judgmental without any facts.

You know, I've been reading this forum for the last few days and all I've seen we're people wishing bad on Carnival. What they fail to realize is that Carnival is people too. How many people will be out of work if the evil Carnival empire were to go bankrupt? This road goes both ways.

Winning money isn't going to change anything that happened.

 

Right. So no one should ever sue for anything because money doesn't fix it. :rolleyes: maybe you should tell that to the Concordia people that had a family member die. Tell them how stupid it is. I love how people not involved can stand back and decide what is right or wrong.

 

And suing isn't always about getting money. It's about punishing the person or company responsible. Maybe carnival should be sued by everyone involved. Maybe it will teach them a lesson about sending out a ship that they knew was having mechanical problems. It's pathetic that people will stand up for a billion dollar corporation and slam the average joe.

It's not about wishing bad carnival. It's about holding a company accountable when something goes wrong.

i dont think anything will happen. Look at the splendor, i dont think anyone sue or won a court case

 

I don't think so either however it irritates me that people who have no knowledge of what actually happened sit back and make judgments on those that were involved. We don't know what it was like and we don't know what each person experienced.

Impossible to file a lawsuit vs carnival with the contract you sign.. Passengers may sue any contest they won to get the cruise or even sue someone that gave them tickets in a civil court.. But no lawsuit will be won vs carnival.. You give up that right when you board under contract.

If they're suing to teach them a lesson then I guess they will donate all the money won to charity since they're not suing for the money. And I guess you better not do anything wrong while on a cruise because carnival should be able to sue you if you leave a suitcase in the floor of your stateroom and your room steward trips on it and gets hurt.

 

50 years ago there were hardly ever lawsuits filed. Why? Because people had accidents and chalked them up to stuff happens. If you slip on a wet floor, get up and realize that you should pay better attention to where you're going next time.

There were 3 women on Good Morning America today we were telling their story. They said that the compensation they received wasn't enough and they would be seeking legal action.

I understand these people went through a trying few days, BUT they aren't hurt, they aren't dead, dying, suffering etc...

I think Carnival did the very best they could have done. One woman last night said she didn't think the ship should have ever set sail to begin with. If that was the case, why did you get on the ship? No one forced you to get on the ship!

 

I think the fact that Carnival compensated this cruise, a future cruise, all expenses expect gift shop and casino purchases and gave them $500 along with paying for travel and putting them in a hotel is more than generous. I just don't see why people are talking about suing?

Call me a cheerleader, but I still don't see a reasonable basis for a suit. I'd say the same regardless of the cruise line.

 

The info about the short in the electrical system and the USCG giving them until the 27th to have it repaired will further indemnify them, if that turns out to be the cause.

 

If people were injured or died, there'd be cause for a suit. Discomfort doesn't qualify. Lost wages may be a reasonable damage, but I strongly suspect that anyone who approaches Carnival with documented evidence of lost wages will be compensated for them without a suit.

There are a lot of facts known. There's also a lot of knowledge of what when on, there's been almost 24/7 news coverage and quite a few posts that reflect what went on.

 

Not ALL the questions have been answered for sure. More needs to be known and that will happen.

 

There may be a few unique issues, but the average Joe has been adequately compensated, save for maybe some work related issues.

Basically, unless you were physically injured on the ship, you don't have a claim. I mean, for compensation beyond what Carnival already offered.
