Guest ldtr Posted January 1, 2023 #5 Share Posted January 1, 2023 (edited) From what I understand about this case the finding was for use of the pier after the cruise lines were notified and the owners property claim was certified U.S Justice Departments Foreign Claims Settlement Commission. The cruise lines including NCLH, CCL and RCL owned lines continued to use the pier and as a result there was over 400 million awarded against the multiple companies. In the case decided in Carnivals favor it appears that the plaintive may had acquired the claim to the property after 1996 which would make them not eligible for damages. In the recent case the plaintive has a documented claim established before that date and thus eligible for damages.
