It's called common sense. Coffee is hot. Give me a break

I guess that is why the jury in that trial ruled in favor of the lady who was burnt. 80% MCDONALDS fault and 20% the ladies fault. Third degree burns from coffee. Read the court transcripts.

Actually, in the United States, it does make it right. You might prefer one of the many dictatorships where you don't have a right to a jury trial.

there is an info channel that displays the ship speed, this was from the glory:

Mostly likely, my logical guess is this person is only used to ferry or river cruisers where they barely go over 10knots or so. Most big commercial vessels only cruise at around 15 knots or so

 

:eek: OMG!!! That's a blazing 26 mph on the highway!...she'd be honking her horn attcha and giving you the one finger wave for driving too slow! Even at 30 knots that's barely the speed limit for most city streets.

Hmmmmmm....I had thought about a lawsuit 'cause it took them too long to get to "international waters" so I could begin donating to the casino. On second thought, maybe it saved me a few bucks so I'll rethink the lawsuit...:rolleyes:

Are you sure you aren't the one who is stupid?Suggest you read about the lawsuit before calling the woman stupid. Hundreds of people got scalded because they kept the coffee way too hot, hot enough to cause third degree burns. Even MdD's internal memos said they should turn down the heat. They also had a lot of people who had third degree burns on their crotches as a result of coffee being dropped on them in the drive through window. All elements of a tort were present.

I don't think I ever knew how seriously injured she was from coffee. Third degree burns are serious. At her age, I'm honestly surprised she didn't die from injuries that serious.

 

Burn incident

On February 27, 1992, Stella Liebeck, a 79-year-old woman from Albuquerque, New Mexico, ordered a 49 cent cup of coffee from the drive-through window of a local McDonald's restaurant. Liebeck was in the passenger's seat of her Ford Probe, and her nephew Chris parked the car so that Liebeck could add cream and sugar to her coffee. Stella placed the coffee cup between her knees and pulled the far side of the lid toward her to remove it. In the process, she spilled the entire cup of coffee on her lap.[10] Liebeck was wearing cotton sweatpants; they absorbed the coffee and held it against her skin, scalding her thighs, buttocks, and groin.[11] Liebeck was taken to the hospital, where it was determined that she had suffered third-degree burns on six percent of her skin and lesser burns over sixteen percent.[12] She remained in the hospital for eight days while she underwent skin grafting. During this period, Liebeck lost 20 pounds (nearly 20% of her body weight), reducing her down to 83 pounds.[13] Two years of medical treatment followed.

Sympathy for people who had hot coffee dropped on them I have.

 

Sympathy for an idiot who puts hot coffee between their legs I do not have and think the judge should have laughed her out of court.

 

Sitting in the passenger seat of a car that just came through the drive through--where would you put the coffee to take off the lid and add the cream and sugar? Just curious. Cars don't have those "tray" insides on the glove compartment like they used to. The only place I have a cupholder is very awkward between the seats and just as easy a place to spill it.

 

Did you see the pictures of her thighs? I wouldn't wish that on anyone.

McD now will add the cream and sugar if you ask and I always let them. Of course, it's also not scalding like it used to be.

Yes, hot is one thing, but hot enough to burn down to the bone is another. She wasn't greedy. All she asked for was medical expenses, a very modest sum, and the company turned her down. They had also been warned. Eventually, the chickens come home to roost. That's how we control safety in this country. Think about a company selling acid and having lids that don't close tightly. That's basically what was happening here.

Perhaps not in your mind. But guess what, like it or not the jury's decision does make it so. So both you and McDonalds are going to have to learn to live with the jury's decision. McDonalds has gotten past this case. When will you?

As someone who gets seasick, I hope she wins this case. I also get car sick so I hope someone sues something or someone related to that as well! (Putting my lawyer on speed dial now that I have someone to blame) LOL

 

Speed in the ocean, like speed on a highway does not cause motion sickness. If that were the case, people in jet going 500 MPH would all suffer from motion sickness.

 

Motion sickness is caused by a conflict between the eyes and ears. If a person is inside and the ship is moving because of the waves (not the speed of the ship - the size of the waves) then the eyes see no movement and the ears sense the movement and motion sickness is the result.

 

You can get motion sickness while sitting still in a house that is not moving if you are playing a computer game that shows a lot of movement. The eyes see movement, the ears sense none and motion sickness can and does happen.

I would use my head and get out of the car put the coffee cup down and than add cream and sugar.

 

When dealing with a hot liquid one should take simple precautions.

 

I do feel very sorry for her but why should someone pay for her carelessness? We should all be responsible for our actions.

Doesn't that follow for corporations too? Getting away from McDonalds and speaking generally, if after proper warning, a corporation makes a cost/benefit analysis that an injury or even a life is worth less than the cost to make a change to their product, should they be held responsible for subsequent injury?

Corporations definitely should. But speaking as someone who likes very hot coffee I lost because someone acted irresponsibly and carelessly.

I hear you, but it wasn't just someONE, it was many people. There are many products that I wish I could purchase, but no longer can because people were careless so I understand your frustration. Some products are taken off the market because ONE person hurt themselves. That drives me batty!

So, at least coffee wasn't taken off the market entirely. In fact, I have read that they have not reduced the temp. Is that not your experience?

I do not generally frequent McDonalds so cannot answer you. However other places that we go to have reduced the temp of their hot drinks.

 

Very often will buy coffee go to my office or home and than put it in microwave to make it hotter. I like to read the paper over a big cup of coffee and will carefully drink it.

 

Now if McDonalds is using a flimsy tray that is not suitable for its purpose and because of that people get hurt shame on them and they deserve to pay for their actions.
