Some things to consider...

 

- Our troops in Afghanistan regularly go on patrols of 7 - 10 days or longer with no hot food or showers.

Thank you for recognizing the service of our troops. My son has served in many difficult places with the Navy Seals. But our troops are trained for their missions, physically and mentally. In some case, they are chosen for their intrinsic abilities to deal with the stresses of deprivation and danger.

 

It is very unfair to somehow diminish what these people are enduring by trying to equate apples and oranges. There are elderly, children,people in not the best health on that ship. They signed up for a vacation, not a tour of duty in the military. They did not have physicals and tests prior to boarding to as ertain their fitness for hardship.

 

What purpose does it serve some here to try to diminish what they are experiencing with comparisons or criticisms or, in many cases, snark? If the intent is to "help" Carnival....think again. If I were one these passengers and read this thread,NOTHING would incite me to sue faster than some of these comments demeaning what I endured or making light of the situation.

Ch3 in Pensacola had a Maritime Atty on this morning with the whole Carnival 12 page contract you sign. He said that its been proven in court, more than once, that bascially the only way they are libel for anything would be personal injury due to their negligence. Duress and mental anguish have never held up in court. Actually they dont even have to, by law, or contract, refund your trip money.

I think the same has already been mentioned on here.

 

I was more amazed at the 12 page contract. I have never seen it, but guess its available.

 

Again I'm not a lawyer......

Finally, a voice of reason in this lawsuit crazy world……….someone with a FB page already contacted a lawyer two days ago……was told the same thing.

Clark Howard says no lawsuits. I'll be curious to see if he's right.

 

being from Atlanta...I don't trust everything the guy says.

 

If there is sewage on the floors and dripping down the walls, then why isn't there more people on deck? I don't think I would be indoors to smell that stench.

Clark Howard explaining the contracts. Also explained that Carnival is getting a commercial that they don't want. The maritime attorney's will push legal action and they won't win but one thing that it will do is bring more attention to this situation. Another passenger stating that until the Coast Guard boarded the ship was a mess and just blasted Carnival for taking the ship out with known problems. You go girl!!!

Understand, this is speculation and has not been confirmed!

 

I spoke to my wife once again and she told me something that shocked me! This is how the conversation went:

 

Wife: "Did the news report about a fatality?"

 

Me: "No, did someone die on board?"

 

Wife: "One of the crew members said an elderly women had an aneurism and passed away."

 

Me: "Are you serious, nobody has heard anything about it!"

 

Wife: "The crew member told us and we've heard it from some other people, I was just wondering if the news said anything?"

 

Again, this is speculation and has not been confirmed!

 

I'm just trying to give all the information I'm getting from my wife other than the personal stuff we've discussed!

If someone has actually died they have my sincerest condolances, but to diagnose an aneurism is difficult under most conditions. From what I have read about the last few days, I would believe this to be extremely difficult. I hope that this is just propogation of an unfounded rumor and is proven to be a falsehood. :o

While Im sure they arent really "enjoying themselves" SOME people make the BEST of any thing that is thrown their way.

 

A concept that is completely lost to some of you in this thread.

Maybe hour 1, 5, 10 or 20.

 

But add hunger, lack of sleep, heat and cold, odd and repulsive smells, it starts to wear thin.

 

I know I was in my own home for 5 days without power after Sandy hit. It gets old real quick, and I didn't have to share that with 2999 others. But I didn't have to use a plastic bag.

I got flamed for saying it'd be difficult if not impossible to sue the cruise line over this because of their contract (which no one bothers to read, but I did) so I'm leaving that one alone!

 

I agree with you but anyone can file a suit, there is just no way to win LOL due to the passenger contract. And I thought I read back during the Concordia that the settlements for that were pretty low all things considered in that case.....

Just got of the phone with my wife who is onboard. She tells me she injured her back when she slipped on a wet deck/floor and is in pain. Now if that was not bad enough, she watched another woman passenger who was more seriously injured, refused treatment by the staff because she would not sign paperwork they wanter her to sign which would require her to pay for services. Now for you "cheerleader" types or the ones who think this is unrelialble information....You can take this to the Bank Bub! My wife and I have no reason whatsoever to fabricate or lie about any of this.

Why do you not have any Carnival cruises on your list?

 

She hasn't taken one.

 

I haven't sailed Costa, but I joined right in on the Concordia conversations last year. And right on threads that were started on the Carnival board, and made their way over there.

 

Same thing happened with RCCL. Thread came over here and was

merged. And now all cruisers can join the convo!:)

Very sorry to hear that. Hope she's not seriously injured. :(

 

CNN live interview with passenger also feeding CNN live video of the sewage that's run down the walls. Passenger recounted hearing what sounded like rain in the elevators. Also recounted two passengers slipping and breaking their hips.

As CNN was speaking with a passenger onboard who sent them video of sewage running down the walls, he mentioned he saw several people slip and fall and two elderly woman break their hips

 

So sad

so sorry about your wife. I hope she can get help from the triage service that was hopefully set up in Mobile.

From the Port Authority the ship needs to make it inside of the bay before 6pm or it will need to wait for sun up.

 

They are currently about 8 miles from the point they have 3 hours to make. It will be very close if they can make this point due to some of the turns they are going to have to make and the time needed to do that.

 

Lets hope for everyone on board they make it.

Carnival has already said they were waiving all charges except Gift Shop Purchases/Casino Charges.... I am sure the forms are "Standard" and include mentions for charges... but are you sure they are trying to force them to pay, or sign normal medical type paperwork that includes language about financial responsability?

contracts are not 100 percent impervious to compensation. In a legal sense they are not worth the paper they are written on, and secondly, they are only designed to scare off the weak, the smart know better. All maritime lawsuits must be filed in Florida, all of them, and as such Florida has very specific procedures in the cruise industry's favor such as burden of proof, time to file, etc. Point being that if they are speaking with an average personal injury lawyer about so called iron clad contracts, and not a Florida law expert that is about as useful as consulting a dentist for appendicitis.

 

And most importantly bad lawyers respect contracts. Good lawyers find loopholes.

If anyone is interested this is the link for our local Mobile NBC station. They have had a live feed all afternoon. It has recently switched to a shot of the cruise terminal and it appears they are getting ready for a press conference. All of the tv stations have been setting up microphones and some of them are live so it should start soon.
