Crusing Nut Posted March 22, 2011 #2 Share Posted March 22, 2011 I saw this and thought you've got to be kidding. http://travel.usatoday.com/cruises/post/2011/03/carnival-cruise-lines-lawsuit-ship-too-fast-woman-sues/148707/1 Beard noted in her complaint that her body "swayed terrible" on the Carnival ship, according to court documents. "I had bleeding, which I had not has [sic] in three years," the complaint said. Most ships in the Carnival fleet are capable of sailing at speeds no greater than 22 to 24 knots -- about 25 to 28 miles per hour. Huh?? Another someone looking to make a buck. Frank12 Posted March 22, 2011 #3 Share Posted March 22, 2011 Good Lord! It's not the speed of the ship, it's the motion of the ocean that makes people sea sick! I guess she can't travel 25 mph in a car either? :(

RWolver672 Posted March 22, 2011 #5 Share Posted March 22, 2011 A few years back I was on our Village Council and we were being sued. Our lawyer's secretary told me that if you have $5, you can sue anybody for anything. This proves it.
mzloolue Posted March 22, 2011 #6 Share Posted March 22, 2011 It sounds very odd. There is not enough information in the article for it to make any sense. Like why swaying would make someone bleed.

JaniceB Posted March 22, 2011 #9 Share Posted March 22, 2011 You don't want to go at snails speed when a storm is approaching. They have to have the ability to go at a good clip.

PCHENG Posted March 22, 2011 #11 Share Posted March 22, 2011 If swaying can cause your body to bleed then all the disco dancers would be dead.
golfadj Posted March 22, 2011 #12 Share Posted March 22, 2011 Maybe they should close all the law schools for about 25 years. Hard to believe somebody would actually take such a stupid case.

mcwebber Posted March 22, 2011 #14 Share Posted March 22, 2011 Maybe they should close all the law schools for about 25 years. Hard to believe somebody would actually take such a stupid case. I think it was Carnival that took it to court beyond small claims. Carnival was appealing the small claims court refusal to dismiss under the cruise contract. You don't need a lawyer to file in small claims.
lroche_nf Posted March 22, 2011 #15 Share Posted March 22, 2011 Someone doesn't understand that its the ocean that makes you seasick...not the ship. She should sue Posiden or God for the ocean having a good chop on when she sailed.
Luv2Travelnow Posted March 22, 2011 #16 Share Posted March 22, 2011 The planet Earth travels at thousands of miles per hour. Has the woman sued Planet Earth for damages for traveling too fast?? USA Today got it wrong? Wow. I can't get over the language of the complaint. "Everyone onboard was sick..." Really? The only generality she can really say is "Everyone onboard was... onboard." Just remember all generalities are false. 8-)
doneinne Posted March 22, 2011 #22 Share Posted March 22, 2011 The judge should laugh at her when he hits his gavel after dismissing the case. How does she know how fast the ship was going? How does she prove that the ship's speed is what caused the sickness and not something else? She can't! What a jokee. The waves cause sea sickness. LHP Posted March 22, 2011 #23 Share Posted March 22, 2011 The scary thing is that IF this were to go to a jury, there are enough stupid people out there that would vote in her favor just because Carnival is a big company. Yet another thing to cause our cruise rates to increase....
