Carnival Liberty Evacuation

We are sailing her in November. We called carnival and they said that if she is not ready for some reason, they would give us another ship...not sure how they just have ships hanging around but hopefully those of you who are cruising before us will be the same situation.

 

I believe what they meant was that if they have to cancel your November cruise on the Carnival Liberty, you will be given the option to apply 100% of your cruise fare to any other Carnival cruise that has a cabin available. In other words, it wouldn't necessarily have to be that same week... just pick a cruise you like and they'll apply what you've already paid towards the cost of the cruise you'd like to go on.

As a passenger, you agreed that only a court in Dade County Florida would have jurisdiction.

 

From the contract every passenger agrees to:

 

© Except as provided in Clause 13 (d) below, it is agreed by and between the Guest and Carnival that all disputes and matters whatsoever arising under, in connection with or incident to this Contract or the Guest’s cruise, including travel to and from the vessel, shall be litigated, if at all, before the United States District Court for the Southern District of Florida in Miami, or as to those lawsuits to which the Federal Courts of the United States lack subject matter jurisdiction, before a court located in Miami-Dade County, Florida, U.S.A. to the exclusion of the Courts of any other county, state or country.

 

(d) Any and all disputes, claims, or controversies whatsoever, other than for personal injury, illness or death of a Guest, whether brought in personam or in rem or based on contract, tort, statutory, constitutional or other legal rights, including but not limited to alleged violation of civil rights, discrimination, consumer or privacy laws, or for any losses, damages or expenses, relating to or in any way arising out of or connected with this Contract or Guest’s cruise, no matter how described, pleaded or styled, between the Guest and Carnival, with the sole exception of claims brought and litigated in small claims court, shall be referred to and resolved exclusively by binding arbitration pursuant to the United Nations Convention on the Recognition and Enforcement of Foreign Arbitral Awards (New York 1958), 21 U.S.T. 2517, 330 U.N.T.S. 3, 1970 U.S.T. LEXIS 115, 9 U.S.C. §§ 202-208 (“the Convention”) and the Federal Arbitration Act, 9 U.S.C. §§ 1, et seq., (“FAA”) solely in Miami-Dade County, Florida, U.S.A. to the exclusion of any other forum. Guest hereby consents to jurisdiction and waives any venue or other objection that may be available to any such arbitration proceeding in Miami-Dade, Florida.

 

And such clauses by cruise lines have been invalidated by courts before. Much of it is there to scare you away from trying to go the court route and just accept whatever pittance they are offering.

Can you site a case where someone successfully sued carnival outside of Florida?

I understand that there are people on the Carnival page and John Heald's page that may be dismissing my posts. No worries, since that does not bother me. I have posted the facts that I have either witnessed myself or have been provided by staff members and crew members. I have tried diligently to only post factual information without bias or emotion. If I posted anything that was incorrect, I have posted updated information. I appreciate all of the nice things that have been said about my posts. To answer a question from yesterday, I am not a journalist, nor do I work in public relations. I am a professional singer and music teacher. In my younger years I performed for several cruise lines as a production singer and dancer. I will post when we get final clearance from the coast guard.

 

Thank you Pauley. Been following your updates. As real as you can get, IMHO. Thanks for taking time out.

As for the people at Guest Services, since I'm not actually there, I choose to see the optimistic side of why people might be there - clarifying the wheres & whens of the OBC, getting details about possible flights from San Juan/Charlotte Amalie, more info about what happened/when it will be fixed, and so on. Information can be scarce in situations like these, and I think it's a part of human nature to lean on others to find out more. It's unlikely that GS knows much more than what has been told to the passengers, but the people in line will find that out the hard way.

 

I'll wait for answers to the more obvious questions from pauley's updates (or elsewhere), but the one I'm most curious about is the cruisers that are waiting to embark in Barbados. It's obvious that the Liberty is not going to make it there tomorrow or indeed any time soon, so they're going to get refunds for sure. But will they get the OBC and the additional cruise credit that the folks who boarded in San Juan got? My inquiring mind would like to know.

Pauleydm, It was so refreshing to hear from someone who is on the ship and is stating facts with a level reasonable head. It is never any cruise lines intention to ruin someones vacation for various reasons, but unfortunately things happen and I think Carnival has first and foremost considered the safety of all their passengers and secondly compensated them extremely well. They can stay on the ship in PR and still enjoy what goes on, on the ship except maybe for the shops and casino, which they have in PR. You have made the best of an unfortunate situation and I commend you for that. Unfortunately you will always have the few, who will think not enough was done. Again thanks for the information, enjoy the rest of your trip. They are always and adventure and this will surely be a memorable one!!!

This will be my one post that will have some emotion attached. Since the announcement was made, there are many upset guests. The line to Guest Relations is very long. We have additional guest services staff from the Glory onboard and a second guest relations desk has been set up on deck 5. I personally feel that Carnival has gone above and beyond considering the situation. The full refund and 50% off a future cruise, not forgetting the OBC already received, has been more than generous. We will definitely sail Carnival again.

 

Thank you for account of what's been happening. It's good to know that in the event of adversity we will be taken care of to the best of Carnival's ability. People who have saved and planned are understandably disappointed in not having their planned vacation but I agree that Carnival has done everything in their power to make the best of a less than ideal situation. I look forward to sailing on the Liberty in December. I'm sorry your vacation wasn't what you planned, but I'm happy for the resolution that was offered.

Bummer that the fire disrupted the cruise, glad to hear no one was hurt. Looks like Carnival has done the right thing regarding refunds ect. You poor people that have been shipwrecked in St. Thomas, wish I was there with you. Wife and I sailed Liberty a few years ago from Miami. Liberty had a propulsion casualty on the way home and we were late several hours. Life is an adventure and you will have sea stories to share with your landlubber friends and family. Have a good cruise to SJ PR. I'd stay on the ship in SJ till they dragged me off.

I just wanted to let you know how much you're posts and updates have been appreciated. I am a TA and I have been following this thread since the fire was announced, since I know I will get factually info without all of the bulls**t or sugarcoating from CCL. I need the facts and only the facts, and you have provided that for us !!

 

Let other's do/say as they will, you are VERY appreciated :)

One of the girls cruising with us this coming Sunday was told the same thing, I didn't think they had a spare just hanging around either!

 

When I called I was told that the Liberty was fine and we WOULD be sailing on it Sunday. Guess we will have to wait and see how this plays out! Fingers crossed for the best!

 

Saw your post and see you are from Guthrie. We are in Broken Arrow and Booked on Sunday sailing on the Liberty too. Do you have any more updates? It doesn't seem likely that we will be sailing. Would you share any thing you might learn? Thanks!

maybe staying close to Liberty "just in case"

 

Probably to follow the Liberty as she sails to San Juan tonight.

 

As has been said, since the Glory is supposed to call on San Juan tomorrow at 7:00 AM staying close to the Liberty makes sense. It probably won't hurt to have her with "ear shot" just in case.
