Injured on ship .. need advice.

Recommended Posts

Can't tell about age from previous posts about age (although the OP doesn't sound particularly old), but regarding place of residence, several posts mention that they live in Orlando, and having lots of choices in ships because of their Florida residence, and several times refers to his wife. So, apparently the op is a male, and does, indeed, live in Florida.

Under the OP's profile, it states date of birth as December 31, 1989.

Happy 19th birthday, OP.

medicare does not cover outside the US- some privately paid for supplemental coverages do(this is what that is). medicare NEVER covers outside the US(there is in fact one exception when your permanent address inside the US is closer to a hospital in Canada or Mexico but it is a rare exception).

Also no attorney will take this case its not worth anything- no permanent damage and no loss of income.

Write a letter and hope for the best. Not every accident winds up in liability the mere fact that water was present(on a ship) is not in of itself enough...

Actually, Medicare Part C MAY cover emergency care overseas, it depends on the insurer and plan. Part C is a Medicare Advantage plan that beneficiaries may choose to purchase rather than the traditional Medicare coverage. It's not a Medicare supplement - it is their Medicare coverage, just not the typical Medicare Parts A&B.

Why can't an accident just be an accident?

Why would you think the staff has the time to stand around staring at every inch of the floor in case someone spills something on it so they can leap into action and throw themselves across the puddle to save the passengers from catastrophe?!

Why is it the cruise lines fault that the accident victim was not looking where she was going? (she seems to think it is everyone's else's job to look at every spot on the floor where she may step)

Why... because there is no personal accountability anymore.

Thank you, thank you, thank you for posting this! There is NO personal accountability anymore, everyone wants to blame someone else , never to take any kind of responsibilty for themselves.

MMMM My tongue is diggin a hole in my cheek here;)

Firstly, travel insurance for a 7 day cruise does not come anywhere near $300 per person.

Secondly, all the RCCL ships have nonskid surfaces coming out of Windjammer with the exception of nonskid tile on some ships right in front of the sliding doors.

Thirdly, I agree with the "Sh1t happens" crowd, if indeed this is a legitimate complaint. I slipped on some water, from people not drying their hands, in the ladies room in the casino on Mariner last cruise, slid across the floor and jammed my finger badly against the wall. After a few choice words, got up, washed up again and went in search of an attendent to report the water and then on to the one armed bandits. That's life. You'd have to have someone on duty 24/7 to be able to wipe up every little drip to keep people from slipping! Fingers o.k. now:)

If the OP's post on CC on Feb. 25/2005 holds any credibility, then this entire thread is a hoax.

On 2/25/05 the OP said her name is Tracey and she and her husband, Devin, were in their mid-30s and newlyweds.

Not sure how the OP aged that many years in such a short time but I do know that at least one of the OP's posts has to be a hoax.

I am a little confused here.

Your posting for Jewel OTS 12-3-05 posted on 2-25-05.

Let me introduce myself - my name is Tracey . My husband Devin and I have a bump balcony on deck 7. (we are mid 30's) We are newlyweds and had our reception for our wedding on a 5 day Enchantment of the Seas cruise. We have only one child - she is a 2yr old black lab, Nala.

We are taking my parents Mike and Elaine (mid 60's) and they are next door to us in a bump balcony on deck 7.

Here is your posting from yesterday on this thread..

Hi. Injured on one of RCCL's ships because coming out the windjammer thru the glass doors outside there was a large deposit of water. There was no warning sign nor was there anyone attempting to clean up. This was a place where one would not have expected water and therefore I fell. I am 71 years old and not prone to falling.

Which is it? Are you in your 30's or 71?

Are you posting taking on your mom's identity or making this up?

Just curious!

Laura

Classic! :D

We saw an ad for an atty specializing in cruise ship accidents on a bus stop bench near the 17th street causeway--I guess these claims come up more frequently than we care to think about...get proper advice if you are not satisfied.. can't give you legal advice but filing claims sometimes involves a short time period-

There are many reasons for cruise insurance. I had much rather lose $100 for the insurance and have peace of mind than $3000 or more. You or a family member could get ill or have some sort of accident. If someone has to be airlifted off of a ship it would cost thousands.

Exactly. And insurance is not necessarily expensive. The TA we use gives insurance for free on cruises 5 days or longer.

That cruise last August was supposed to be our honeymoon, leaving 3 days after our wedding. My mother was admitted to the ICU the day after my wedding and passed away a few weeks later. The last thing my new DH and I wanted or needed to worry about at that point was losing $2300 on a cruise we'd have to miss. Thankfully, our claim was accepted and I was able to focus totally on my mom.

So for those of you who are young, in good health, etc. and believe you don't need insurance---please rethink that.

these are private policies not under Medicare. medicare allows standardized supplemental policies with different letters covering them but these policies every single one is not a medicare policy but a medicare supplemental policy issued by a private issuer. medicare does not cover outside the US. It may be semantics but its not covered under Medicare but the supplemental privately issued policy. these policies vary by the state of residence of the policy holder and not every state permits the issuance of each of the standard supplemental policies. Its not medicare coverage. Its a privately issued medicare supplemental policy. medicare will not cover outside the US.

Some Medicare HMO policies(where you have opted out of basic medicare) will also pay out of country but again this is NOT a medicare payment but the supplemental part the HMO supplies.

You are asking for advise.......here you go....

PAY THE BILL AND GET OVER IT!!! S**T Happens. Stop trying to blame RCI for something they did not intentionally set you up for and your lack of seeing and avoiding the water puddle. Stop wasting valuable minutes of your life complaining about things like this. You can never get these minutes back. Move on.

Geez...all he wants is to have his medical bill paid. This is just like any sli-and-fall incident on land. The cruise line has a certain "duty of care" to keep walkways safe. Either the ship is self-insured or they have a liability policy. I did not feel like reading the subsequent posts so I hope your issue is resolved and you have recovered.

OP may be her father since the post was 2005 and he was sixty something. He may be posting on her name.. who knows but sounds possible.

My DH is on medicare also and our supplemental coverage, BC/BS covers up to $50,000 out of the country. SO we always take insurance to cover over that amount and also evacuation coverage. It is very expensive coverage if you are older.

A seventy year old man posting on his 30-something married daughter's screen name? And if this is on the level, why does she list her birthday in her profile as December 31, 1989?! She said earlier that she was in her 30's!

It's just really hard to take this OP seriously with all the discrepancies. Not that the situation described is all that uncommon in today's litigious society.

Good news! It's not at all expensive. Go to statravel.com. They do not take into account your age. Up to 8 days, $48; 9-15 days, $70. And I was pleasantly surprised to learn, after we had a minor medical bill on board, that they take care of a year of follow-up medical care if needed.

OP must be a 19 year old computer hacker who HACKs into Women's computers and steals their ID. Hence the screen name of HACKWID. How else can someone have a birth date of 12/31/1989, signs on as a mid 30s newly wed woman, and falls as a 71 year old?

The first thing that jumped out at me when I read this is that you say no one responded to you but your "party" was videoing everything. If my husband or friends was videoing while I'm on the floor in pain that would not be a good thing!!!!! Sounds like someone trying to sit up a lawsuit or film a youtube clip.

I can't say enough times that we have self responsibility and if you choose not to purchase insurance you are rolling the dice and apparently they didn't come up well this time. It's unfortunate and I am sorry that you are hurt, but as far as the bill goes, that was you choice to take that gamble. I've spent tons on insurance over the last few years and rarely needed any but if I do I'll be prepared. If I neglect to buy it and I need it that's my own fault.

When we have used the medical facilities on board it's actually been less than if we went to an emergency room at home. I know the wheelchair seems high but if you ever look at an itemized hospital bill where you pay for each item you will have a heart attack over the cost of a tylenol or even of a box of kleenex!
