For what's it's worth, the pecking order for right-of-way at sea is:

 

1. Being Overtaken

2. Not Under Command

3. Restricted Ability to Maneuver

4. Constrained by Draft

5. Fishing

6. Under Sail

7. Power Driven

8. Seaplanes
