I keep thinking Disney when I hear Wonder of the Seas

Unfortunately it is common for cruise lines to copy each other names

Freedom of the Seas = Carnival Freedom

Radiance of the Seas = Carnival Radiance

Liberty of the Seas = Carnival Liberty

Jewel of the Seas = Norwegian Jewel

Disney Dream =  Carnival Dream

Disney Magic = Carnival Magic

at least with Royal, you have 'of the seas' which lessens the confusion.

 

but with Carnival, surprised Disney didnt sue Carnivale to get them to rename

Also ALL the 6 (current & future) ships of Regent Seven Seas Cruises have the words used by Royal Caribbean: Navigator, Mariner, Voyager, Explorer, Splendor, Grandeur

Pretty much all the good names were used on the earlier ships.

 

Sovereign, Majesty, Monarch, Legend, etc.

 

Personally I think Voyager Class has the best names.

 

Now the names just get dumber & dumber as they go.

 

HAL reuses names for their new ships and now Carnival is doing the same bringing back  Mardi Gras, Celebration, and Jubilee..

So look, I'm literally a trademark attorney by profession. But short of inventing brand new completely arbitrary words, there are just so many names you could use for a cruise ship. 

 

I just don't see any actual confusion or likelihood of confusion (the standards in trademark law) here.

would have thought these 2 would be candidates for lawsuits?

Lol I've known people that just knew (for example) that they were going on the "Freedom".  It never occurred to them that there was an "of the Seas" or "Carnival" as part of the name.

No, not really. Okay, I'm going to legal-nerd out now.

 

Full disclosure: I currently teach intellectual property at a law school, with a specialization in trademarks. I have served as an expert witness in trademark litigation on the standard of likelihood of confusion. Prior to going into private practice, I was a Trademark Examining Attorney at the US Patent and Trademark Office for more than a decade. (In other words, I made registrability decisions.)

 

The standard is likelihood of confusion. Depending on whether we're talking USPTO registration, trademark infringement lawsuit, and/or which courts are looking at the case, there are a number of factors that are weighed when determining likelihood of confusion. But basically it boils down to this:

* Similarity of the marks

* Relatedness of the goods or services

 

Must have both prongs of this analysis.

 

Similarity of the marks is compared for sound, appearance, and meaning.

 

With respect to DISNEY DREAM and CARNIVAL DREAM, we can just ignore the relatedness of goods/services analysis entirely, because not only are the services related, but they're identical. Both are cruise ships. No argument here. So we focus our scrutiny on the similarity of the marks prong.

 

The marks at question are DISNEY DREAM and CARNIVAL DREAM. Only common elements here are the final word/syllable: Dream.

 

Let's go through the factors:

Sound: Disney Dream has 3 syllables, with phonetic emphasis on Disney. Carnival Dream has 4 syllables, with phonetic emphasis on Carnival. Dream is identical in both marks, but isn't the dominant portion of the commercial impression. 

Appearance: Again, Dream is identical in both, but there as the secondary wording in the mark, the house marks (Disney vs. Carnival) are dominant. These marks just look very different.

Meaning: They have different commercial impressions. You focus on the Disney or the Carnival portion primarily, and those import the greatest meaning into it. But you could also think of it in terms of being a play on words, like "Disney dreamin'". 

 

As an examiner, I never would have cited either of these marks against the other, and FWIW, it's worth mentioning that the examiner assigned evidently didn't see a likelihood of confusion either.

 

DISNEY DREAM received US registration 3948324 on April 19, 2011.

CARNIVAL DREAM received US registration 3764524 on March 23, 2010.

 

It's worth noting that Carnival applied on October 16, 2008. Disney applied on March 10, 2009. The Carnival application was published for opposition (gives third parties 30 days to oppose registration, which would start a trial for priority and registrability in the Trademark Trial and Appeal Board) also on March 10, 2009. Disney did not oppose Carnival's registration. Nor did the USPTO examiner issue a refusal of the Disney application based on LOC with the earlier Carnival app, nor did Carnival oppose Disney's registration.

Consider yourself lucky if you don't know the story behind this one. Thanks to Carnival Triumph I have a non-cruiser friend who still gives me grief by asking me if I am taking extra 💩  bags with me whenever I cruise.
