NCL granted preliminary injunction against Florida allowing them to request vaccine info

Remember some on this board thinking NCL wouldn’t get anywhere with this. Well this is certainly interesting. If NCL wins then the cruise lines including Carnival will be able to go fully vaccinated and require proof.

For Carnival what does this mean?  For now and the near future Nothing will change.  They will watch the appeal process.  If it looks like Florida can not protect their guidelines, then Carnival will go from 95% vaccinated / 5% unvaccinated to 100% vaccinated.  Make no mistake this is what Carnival prefers to help them move forward to 100% cruising out of the USA.

Nothing is going to change in the near term for Carnival from this suit or the Florida/CDC suit. As younger than 12 can be vaccinated, I expect the 95% number to go up.

I could see the cruise lines requiring everyone 12 and over to provide proof of vaccination but still requiring that those with children 11 and under file for an exemption.

Before the end of the year vaccine will be approved for children.

All cruises will be vaccinated only for all eligible, no exemptions required.

Excellent news here for all cruise lines, no doubt NCL wins in the end

There are easier and far more cost effective methods to require proof than dealing with legal teams and going for injunctions. It goes down like this...

  • When checking in for your cruise, optional proof of vaccination is entered
  • If you refuse or do not have proof of vaccination you agree to the following:
    • For each passenger you agree to a $150 covid test for the entire cabin per person. The test is given daily. Results take 8-12 hours to come back in which time you are quarantined to your cabin. 
    • You are required to purchase NCL's unvaccinated insurance policy. The cost is $1,000 per person. It only covers the cost of on-ship quarantine and nothing else.
    • You are responsible for the cost of 24/7 policing that each person in your cabin follows the unvaccinated policies. The cost for this is $25/hour per person in the cabin.
    • You are required to wear a mask 24/7, even in your cabin while sleeping. There is no warning for mask removal. If anyone in the cabin removes their mask at any time, you are immediately locked in separate quarantine with an emergency medical evac by helicopter at your own personal expense.
    • You cannot debark the ship at any port.
    • You cannot be anywhere on the ship with more than 4 people in the venue or location. This includes any dining facility, casino, lido deck, etc. You are required to know if there are more than 4 people in the location before you exit your cabin. If you do not know, you cannot leave your cabin. 

This is not rocket science people. Make it so unaffordable and restrictive that no unvaccinated person would event travel. Are you telling me you would agree to nearly $50,000 in added expense on a $3,000 cruise?

I'm not sure carnival wants 100% or they could exempt fewer than they are now easily. They dont want to upset any more than they have to,

I think with the new mask mandate, they've already upset more vaccinated passengers than the total number of unvaccinated allowed per ship...

 

I have always said...the only way they could resume sailing with success is to go 100% vaccinated...anything less would be a mistake....yes, I am aware that there are cases even with the vaccinated, but not nearly as many nor as severe.

 

We had 6 cruises booked between now and next fall.....already canceled Sept...just playing it by ear as the next date (Nov) approaches....fingers crossed that people and cruiselines can get themselves together here soon....

For whom? Carnival or NCL? NCL maybe but I doubt it will be in place for carnival that quickly or if at all depending on what  route carnival wants to take.

or is this "Until the next court says different"? Honestly the way the system is set up the first verdict is never yes or no just a maybe till it gets to the next judge.  What is going to happen when the 100% still continue to develop Covid on board? I believe catching Covid on vacation or in your daily life is going to be like coming home with a cold soon enough. The number (havent seen more than 10 reported yet) and severity (mild to little to none) of so called "breakthrough" infections on Cruise ships so far has been handled with protocols no differently than an outbreak of Noro would be handled.  Dont believe there will ever be a zero case sailing going forward just as there will never be  zero cases of Covid on land going forward.  But hey that's just my opinion.  Im cruising in November and will deal with any "colds" i catch when it happens.

Having cruises on one complete and another in progress, my take is the Carnival

plan is working just fine.  Ask Del Rio how much recenue he has taken in from

thr us market in the last month?

All we know is this ever changing and evolving......post are just opinions.....I agree that numbers will go up if Cruise lines have their choices, but how will Disney cope?

 

Just wishing everyone a safe enjoyable cruise.....practice common sense and hopefully all will be well.

I believe the judge anticipated this appeal.  Florida won an injunction in the 11th Circuit regarding the constitutionality of the CSO.  Therefore, the judge did not rule on NCL's argument that the Florida law is superseded by the CSO, which could have made a contradictory ruling to the 11th Circuit's decision that the CSO is legal.  So, now the 11th Circuit has to decide this on the free speech and dormant commerce clause arguments, not anything to do with the CDC or CSO.

For the most part, I can tell you as I am on my back half of a side to side, and both the cruise line and the VAST majority of cruisers are doing the right thing.

This doesn't change anything for Carnival other than making their lives easier if NCL wins. Carnival was already in blatant violation of the Florida law by requiring some passengers to show proof of vaccine. My guess is that Carnival was waiting for Florida to start fining them the $5k per vaccine check and then contest it in court. Or they were playing chicken with Florida to see if they intended to enforce it in the first place.
